SparkSMS ("we," "us," or "our") operates the SparkSMS Shopify application and the website sparksmsapp.com. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our services.

• Merchant Information: When you install SparkSMS, we collect your Shopify store domain, access tokens, and account details necessary to operate the service.
• Customer Data: Through your Shopify store, we access customer names, phone numbers, email addresses, order history, and purchase data solely to provide SMS services on your behalf.
• SMS Opt-In Data: We collect and store records of customer consent to receive SMS messages, including the date and time of opt-in.
• Message Data: We log SMS messages sent, delivery status, click tracking, and response data.
• Usage Data: We collect data about how you use our dashboard including pages visited and features used.

2. How We Use Your Information

• To provide and operate the SparkSMS service
• To send SMS messages to your customers on your behalf
• To provide analytics and reporting on campaign performance
• To process billing and payments
• To provide customer support
• To improve our services
• To comply with legal obligations

3. SMS Data and Compliance

SparkSMS is committed to SMS compliance under the Telephone Consumer Protection Act (TCPA) and carrier regulations including 10DLC requirements.

• We only send SMS messages to end users who have explicitly opted in to receive them
• We maintain records of all opt-in consent with timestamps
• We honor all STOP requests immediately and permanently
• We do not sell or share phone numbers or SMS opt-in data with third parties for marketing purposes
• Customer phone numbers are used solely to deliver SMS messages on behalf of the merchant whose store they opted in to

4. Data Sharing

We do not sell your personal information. We may share data with:

• Telnyx: Our SMS delivery provider, who processes messages on our behalf
• Shopify: As required by the Shopify API integration
• Stripe: For payment processing
• Service Providers: Hosting, analytics, and infrastructure providers under confidentiality agreements
• Legal Requirements: When required by law or to protect our rights

5. Data Retention

We retain merchant data for the duration of your account and up to 90 days after account closure. Message logs are retained for 12 months. SMS opt-in consent records are retained for a minimum of 4 years to comply with TCPA requirements. You may request deletion of your data by contacting us.

6. Data Security

We implement industry-standard security measures including encrypted data transmission (TLS/SSL), encrypted data storage, access controls and authentication, and regular security assessments. However, no method of transmission over the internet is 100% secure.

7. Your Rights

Depending on your location, you may have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your data
• Object to or restrict processing of your data
• Data portability

SparkSMS is not directed to children under 13. We do not knowingly collect personal information from children under 13.

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting the new policy on this page with an updated date. Your continued use of SparkSMS after changes constitutes acceptance of the updated policy.
